In a recent incident in Okaloosa County, Florida, a sheriff’s deputy’s misinterpretation of a sound led to a potentially dangerous situation.

The deputy mistook the sound of an acorn striking his patrol cruiser for gunfire and subsequently fired multiple shots at an SUV where a handcuffed Black man was seated in the back.

Fortunately, the man emerged unharmed from the November 12th shooting and was later released without charges. The officer involved in the shooting chose to resign amidst the aftermath of the incident.

The Okaloosa County Sheriff’s Office made public both the body-camera footage and an internal affairs report concerning the incident. According to the report, investigators observed an acorn falling just moments before the shots were fired, leading to the conclusion that the sound had been misidentified. The acorn had simply bounced off the roof of the patrol vehicle.

The events unfolded when Deputy Jesse Hernandez, along with a sergeant and another deputy, responded to a call regarding a stolen vehicle and alleged threats made by the suspect’s boyfriend.

The caller informed the authorities that the suspect might be armed, heightening tensions during the encounter. Upon arrival, the suspect was apprehended and placed in the back of Hernandez’s patrol car for questioning.

It was during this questioning that the acorn struck the vehicle, triggering a series of events. Hernandez, upon hearing what he believed to be a gunshot, reacted instinctively, fearing for his safety.

He fell to the ground, yelling “shots fired,” and discharged his firearm into the patrol car. Sgt. Beth Roberts, reacting to the perceived threat, also discharged her weapon into the vehicle.

While the State Attorney’s Office found no grounds for criminal charges, the internal affairs investigation by the sheriff’s office concluded that Hernandez’s use of force was not objectively reasonable.

Consequently, Hernandez chose to resign from his position on December 4th. However, Sgt. Roberts was exonerated, with her use of deadly force deemed reasonable under the circumstances.

Sheriff Eric Aden acknowledged the traumatic nature of the incident for the suspect and emphasized the incorporation of the incident into the training protocols for deputies.

Despite the conclusion that Hernandez’s actions were not justified, Aden expressed belief that the former deputy did not act out of malice. Aden emphasized that Hernandez’s response stemmed from a genuine fear for his life based on the circumstances he perceived.

Reviews conducted by both the sheriff’s criminal investigations division and the State Attorney’s Office yielded no probable cause for criminal charges against Hernandez.

It’s worth noting that Hernandez had joined the agency relatively recently, in January 2022, indicating that the incident occurred early in his tenure as a deputy.

The incident in Okaloosa County serves as a stark reminder of the challenges law enforcement officers face in high-pressure situations. It underscores the importance of training and preparedness in effectively navigating such scenarios.

Moreover, it highlights the need for ongoing efforts to foster better understanding and communication between law enforcement and the communities they serve, particularly in instances involving potential use of force.

Moving forward, it is imperative for agencies to continue refining their protocols and training procedures to minimize the likelihood of similar incidents occurring in the future.
