No Jail Time for Insane Man who Abused Children while Pretending to be a Woman

In Kentucky, a mentally unstable person who identifies as transgender and was accused of sexually abusing a baby has struck a plea deal to avoid prison time, provided certain conditions are met. Maria Childers, a former daycare worker, enlisted a well-known transgender rights advocate as legal representation in the disturbing case.

Childers’ arrest in February 2023 followed an anonymous report to the Department of Community Based Services (DCBS) regarding alleged abuse at Explore Learning Academy in November 2022. The report, purportedly from a co-worker, accused Childers of making inappropriate remarks and touching an infant inappropriately while changing their diaper.

Further details from court records revealed accusations of both physical and sexual abuse during Childers’ tenure at the daycare. Subsequent investigation by a DCBS case worker and a Paducah Police Department officer, supported by witness testimonies, corroborated the initial report. Witnesses described instances of neglect, including leaving children unattended for extended periods.

Despite being reported to management, Childers faced only minor disciplinary action. During police questioning, Childers initially denied involvement but later admitted to changing the diaper when presented with evidence. While denying making inappropriate comments, Childers conceded to often speaking in ways “taken out of context.”

Childers faced charges of 1st Degree Sexual Abuse of a Victim Under 12 and 1st Degree Criminal Abuse of a Child Under 12, resulting in arrest and booking at McCracken County Jail. The spelling of Childers’ name varied across official documents.

Following legal representation by transgender activist lawyer Madison Leach, Childers’ bond was reduced after Leach raised concerns about hormone therapy access in jail. Ultimately, Childers’ bond was reduced, and conditions for release included avoiding contact with children and the daycare.

On January 29, 2024, Childers reached a plea deal, pleading guilty to Class A Misdemeanor Sexual Misconduct in exchange for dropping other abuse charges. Judge Joseph Roark imposed a 12-month penalty with a conditional discharge for 6 months. Compliance with court conditions during this period would result in no prison time or criminal record.
