Sources familiar with the matter inform CNN that a current and former law partner of Nathan Wade, the special prosecutor leading the 2020 election subversion case in Georgia, are anticipating subpoenas to testify at an upcoming hearing.

This hearing, scheduled for next month, will address concerns about a potential conflict of interest involving Wade and the district attorney, Fani Willis, who brought the case.

The alleged affair and financial ties between the two have raised questions about their impartiality.

In addition to the anticipated subpoenas for Wade’s law partners, it is expected that Willis herself and possibly others in her office will also be subpoenaed.

The hearing comes at the behest of a Fulton County judge overseeing the criminal case against former President Donald Trump and his associates.

One of Trump’s co-defendants, Mike Roman, has raised claims of a conflict of interest, arguing that financial benefits flowed to Willis when Wade took her on extravagant vacations after being appointed as special prosecutor.

Ashleigh Merchant, Roman’s defense attorney, expressed confidence in the evidence they have gathered, including financial statements from Wade’s divorce proceeding.

While the allegations may not likely derail the ongoing case, they have become a significant distraction. Critics argue that these allegations provide Trump and his allies with ammunition to claim that the case is a product of a corrupt justice system targeting him.

Merchant indicated that the evidence presented at the hearing, including potential witness testimonies via subpoenas, will depend in part on Willis’s response to the allegations.

The judge overseeing the case, Scott McAfee, has directed Willis to provide a written response by February 2.

It is anticipated that Willis may resist any subpoenas for herself or her staff, as she is already attempting to quash a subpoena to be deposed in Wade’s divorce proceeding. While Willis has proposed a trial date in August, no official trial date has been set yet.
